We Know How to Navigate the Complex Tax Maze

IRS and State Controversy

Representing clients before federal and state tax authorities to resolve disputes has become the mainstay of our successful firm. While serving thousands of clients for over three decades, we have developed essential working relationships with representatives from the IRS and State Tax Departments who have the authority to make decisions and ultimately settle cases for our clients.

Offer in Compromise

An Offer in Compromise is a resolution made between a taxpayer and the IRS wherein the agency agrees to accept payment of only a percentage of the debt owed in order to settle the case. This situation occurs most frequently when it is unlikely that the taxpayer will ever be capable of paying off the entire liability, or when there is question about the validity of the amount owed.

IRS and State Audits

Although only about one percent of tax returns are audited by the Internal Revenue Service, receiving an audit notice or any letter about taxes can be a frightening experience for even the most financially savvy individual. We deal directly with the IRS and state tax agencies on your behalf. The most important advice we offer is to never ignore an audit notice from the IRS or State Tax Agency.

IRS Levies and Liens

When a taxpayer fails to pay back taxes, the IRS may issue a Notice of Federal Tax Lien or a Notice of Intent to Levy against the taxpayer's property (car, home, bank account, cash value of life insurance policy, etc.). If one of these notices is received, we can uncover opportunities to have the lien or levy released, and negotiate on your behalf to have IRS representatives re-evaluate the situation.

Installment Agreement

Many people who find themselves with a tax liability they cannot afford to pay aren't sure what to do. The IRS may assess penalties to taxpayers for failing to file a tax return and for failing to pay taxes they owe by the deadline. We can assist you in submitting an Installment Agreement, wherein you make make manageable monthly payments to the IRS over a period of time to pay off your tax obligation and avoid further penalities and interest.

Foreign Bank Account Reporting (FBAR)

Federal law requires U.S. taxpayers to annually file a Report of Foreign Bank and Financial Accounts (FBAR) if they own or are signatories to foreign financial accounts with a collective total value exceeding $10,000. Federal law has extablished severe penalties for failure to file an FBAR. Our Firm can assist you in resolving any outstanding FBAR issues as well as minimize penalities.

Best of the Best!

I requested to speak with Mr. Davidoff because I wanted to be assured that I was protected from a State Tax issue I have been having. After doing some research and getting referred to him, I knew I would have the best to advise me. He made time for me and reassured me that I am safe. In speaking with him, it's evident how experienced he is and I truly felt calmer after speaking with him for 5 minutes. He took his time and I truly felt I was a priority. Thank you Mr. Davidoff!!!

Resolved IRS Error

I was receiving threatening letters from the IRS due to a clerical error by a realtor. IRS insisted I owed $3.5M, when I really owed nothing. Had to hire Marty Davidoff's firm. Worked primarily with Alison Gadoua. Alison worked non-stop (and during the pandemic as well) in having the IRS realize an error was made, and the letters stopped. Finally resolved after a long 2 years, and my name was cleared. They had held up my tax return, but I received it with interest when all was resolved. I could not have done that on my own. Very happy Marty's firm was on my side.

Accomplished the Impossible

Nicole Bononi-Wilson accomplished the impossible after my accountant was unable to rectify an issue that had been dragged out for years. After Covid it is nearly impossible to correspond with the IRS. Nicole persisted and fought nonstop until our issue was resolved. Somehow she always knew someone else to speak to or some other method of getting in touch. Highly highly recommend for any IRS problems. Grateful to have found her. And she is always accessible, getting back to you nearly instantly even on weekends and evenings. Truly impressive.

NJ State Tax Problem

After MANY attempts and MANY years of trying to reconcile my New Jersey state taxes, I was completely defeated. My phone calls and emails were either being ignored or they were passed on to different agents. This situation continued until the day that my bank account was frozen even though I had been making payments that I could barely afford. Thankfully, this is when I contacted Amy Marder. Because of her superior knowledge of the tax laws and her true sense of justice along with an impressive tenacity, my case was resolved well beyond my expectations.! I highly recommend Amy Marder for all of your legal tax needs.

Advocacy with Precision

Having hired Marty and his team after working with tax counsel at two prior firms we were looking for an effective advocate, not merely someone to oversee and submit our filings. Marty didn't over-promise and his team delivered as a result. An expert at the process, the Davidoff team worked in unison (lawyer and admin) without wasting time or opportunities. As a result, we were able to resolve our problem within a matter of months, not years. The team at Davidoff was very efficient, and the support of Meghan was super helpful in providing capable organization for working with the bureaucracy involved. Job well done!

Marty Davidoff and his organization are the professional Accountants & Attorneys. Marty referred me to Nicole M. Bononi-Wilson upon our initial consultation and, she outlined a plan of action, with options to address my tax filing with successful results. Throughout the process, Nicole and entire office staff (Rachel, Rob, Kathy, Bonni) provided exceptional expertise with my case. The Person You Want in Your Foxhole

I could not have been better represented than by Marty and his associate, Alison in my dealings with the IRS. I owed a considerable amount of money to the IRS for past arrears and through Marty knowledge of the IRS. and advise and guidance, they were able to save me a significant amount of money off of the arrears owed and prevented further collection efforts for the foreseeable future. You could not find someone who is more knowledgeable of the system and no one I would rather have to advise and represent me in tax related matter. You would be hard pressed to find better representation than Marty and his office

Deeply Grateful

Nicole Bononi-Wilson, part of Marty's team, was an absolute pleasure to work with. She was tenacious in getting my case (which should have been cut and dried) to a successful resolution not only in terms of an installment plan but in also preventing a lien being placed against my property. Nicole was extremely personable and always inquired after my well-being as well as my daughter's. I highly recommend Marty and his entire team - they navigated the entire process with the IRS in a way the average person can't. Best decision I made. Cannot thank you enough.

Exceptional Service

I have been having an ongoing issue with NJ Division of Taxation and ultimately ended up filing a complaint in Tax Court. When the language and process became more than I could handle a friend of mine referred me to Marty Davidoff. From the moment I called and spoke to Rachel and than had a follow up call with Rob and later a 30 minute consult with Marty that turned into 2 hours on a Saturday afternoon I was treated by all three with such professionalism, courtesy, patience and knowledge like no other. Marty not only provided me with a strategy on how to approach my next mediation but educated me on NJ law and provided case law pertaining to my lawsuit. These words do not do justice in expressing the gratitude and respect I have for this firm and giving me by far the best experience I have had with an attorney from beginning to end. Thank you to all who helped.

Simply the Best

Marty worked with me through a very challenging personal tax controversy. In terms of doing business he is highly organized and meticulous and makes heavy use of technology, particularly through his firm's portal. There is no doubt that he is using time wisely and providing cost-efficient service. Marty not only has a thorough substantive knowledge of the Code and the IRS procedures manual, he has a good sense of the positions the IRS will take under various circumstances and the likely outcome. He knows what is important to resolve a case and how to get there. Frankly, he also knows how to push a client to keep them in the safe zone even if it is an uncomfortable conversation. At the same time, Marty is personable and relatable which is very comforting when you are in difficult circumstances. He is also surrounded by an excellent team who invariably follow-up and do what they say they are going to do when they say they are going to do it. Marty has a very well-deserved reputation as one of the best tax controversy lawyers in the country.

Fantastic Tax Advisor

I hired Marty for help with an IRS issue from my prior CPA. Marty is extremely knowledgeable in the area of taxes, which was very comforting for me. Amy, who was on his team, kept the process moving with document requests and information sharing. Marty soon brought Nicole onto the case, who was fantastic as well. Nicole was very communicative on what to expect, and explained clearly how to successfully navigate through the process with the IRS. When the IRS is involved, they quickly can overwhelm you with documents, threats and requests. Nicole was able to address all issues, bring clarity around the process, calm the situation down and bring the situation to a resolution that was in my favor. This is a wonderful group of advisors to work with. I would recommend them to anyone in need of having a tough team, with fantastic communications skills.

Best Tax Law Firm

We hired Mr. Davidoff and his team Alison Gadoua and Amy Marder because of their education, expertise and years of experience in the field of tax law and dealing with the IRS and State of New Jersey. Mr. Davidoff is not only a lawyer, but also an accountant. We ran into problems with back taxes that we owed (both Federal and State). They were remarkable in getting things done and helping to prevent us from having liens. They worked efficiently and quickly to communicate with both IRS and State of New Jersey. They were also kind and supportive for everything we were going through. Their Accountant at the time, Michael Brown, CPA was also excellent and thorough. We can't say enough good things about the firm. Honestly, they were the best, that we have ever dealt with! We would highly recommend them! Many thanks, Marty to you and your team!

Frequently Asked Questions

I received a notice from the IRS. What should I do?

The IRS sends notices to taxpayers for a variety of reasons: to notify you of changes to your account, to request additional information, to request payment of taxes, audit notification, etc. Each notice offers specific instructions as to how to satisfy the inquiry. If the IRS notice represents a more serious or complex issue, it is important you take immediate action. The consequences for ignoring an IRS notice may be dire and can include wage garnishment, asset seizure, arrest and jail time. Your best course of action is to contact a licensed tax professional who can advise you of your options and recommend your best course of action.

Why do I need a Tax Attorney?

A tax attorney is a licensed professional who specializes in working with taxpayers to resolve problems with the IRS or State tax authorities. A tax attorney can help you navigate the maze of State and Federal tax laws to successfully settle an IRS audit, arrange installment payments for back taxes, reduce fines or interest charges, remove liens, or properly establish a new business.

Should I file back tax returns even if I haven't received an IRS notice?

Sometimes individuals and businesses have reasons for not filing tax returns, very often for multiple years. Maybe the business is losing money and you don't have the funds to pay the taxes owed, or there are other health or personal issues. Regardless of the reasons, the consequences for noncompliance can be severe. Even if you have not yet received a notice from the IRS, your account will still be assessed interest and penalties from the date your taxes were due. The longer you postpone filing, the higher the amount owed to the IRS will be. The best approach you can take is to contact a licensed tax professional to assist you in filing your late returns before you get contacted by the IRS. If it is determined that the amounts owed to the IRS are unaffordable after preparing your back returns, our tax professionals can give you advice as to payment plans and options you would qualify for.

I can't afford to pay what I owe to the IRS. What options are available?

The IRS offers multiple options to taxpayers who are not able to satisfy their balance due. Once submitted and approved by the IRS, an Installment Agreement allows the taxpayer to repay the IRS through a monthly payment plan. An Offer in Compromise can be made whereby the IRS may accept payment of only a portion of the debt owed in order to settle the case. Please contact our office to set up a consultation to discern which plans would be best suited to your individual situation.

I received an IRS notice that my ex-spouse owes taxes. Amy I liable?

When a married couple files a return jointly, both parties are legally responsible for the entire tax liability, even additional tax, interest and penalities that arise after they divorce. Even if your divorce decree states that your former spouse will be responsible for any amounts due on previously filed returns, the IRS will still look to you to satisfy the debt. In some cases, however, a spouse may qualify for relief as an Innocent Spouse, or for Equitable Relief or Separation of Liability Relief. Our tax professionals can assist you in determining your qualifications for the various programs and assist you in submitting your application for relief to the IRS.

There is a Federal Tax Lien on a property I wish to sell. What can I do?

A tax lien is a claim against your personal property that the government uses to protect its interests in tax debt. The IRS can place a lien against you and your property if you ignore notices that you owe taxes. It is important to note that the IRS may continue to hold a lien even if you declare bankruptcy. While the easiest way to have a Federal tax lien lifted is to pay the taxes that are owed, this is not always possible. Our tax professionals can assist you in determining your options in navigating the complex process of getting a Federal tax lien lifted.

Do I have any rights as a Taxpayer?

Every taxpayer has a set of fundamental rights they should be aware of when dealing with the IRS. These are:

  • The Right to Be Informed
  • The Right to Quality Service
  • The Right to Pay No More than the Correct Amount of Tax
  • The Right to Challenge the IRS's Position and Be Heard
  • The Right to Appeal an IRS Decision in an Independent Forum
  • The Right to Finality
  • The Right to Privacy
  • The Right to Confidentiality
  • The Right to Retain Representation
  • The Right to a Fair and Just Tax System
A detailed explanation of each of the above Taxpayer Rights can be found here: Taxpayer Bill of Rights.
