Representing clients before federal and state tax authorities to resolve disputes has become the mainstay of our successful firm. An Offer in Compromise is a resolution made between a taxpayer and the IRS wherein the agency agrees to accept payment of only a percentage of the debt owed in order to settle the case. This situation occurs most frequently when it is unlikely that the taxpayer will ever be capable of paying off the entire liability, or when there is question about the validity of the amount owed.
Although only about one percent of tax returns are audited by the Internal Revenue Service, receiving an audit notice or any letter about taxes can be a frightening experience for even the most financially savvy individual. We deal directly with the IRS and state tax agencies on your behalf. The most important advice we offer is to never ignore an audit notice from the IRS or State Tax Agency.
When a taxpayer fails to pay back taxes, the IRS may issue a Notice of Federal Tax Lien or a Notice of Intent to Levy against the taxpayer's property (car, home, bank account, cash value of life insurance policy, etc.). If one of these notices is received, we can uncover opportunities to have the lien or levy released, and negotiate on your behalf to have IRS representatives re-evaluate the situation.
Many people who find themselves with a tax liability they cannot afford to pay aren't sure what to do. The IRS may assess penalties to taxpayers for failing to file a tax return and for failing to pay taxes they owe by the deadline. We can assist you in submitting an Installment Agreement, wherein you make make manageable monthly payments to the IRS over a period of time to pay off your tax obligation and avoid further penalities and interest.
Federal law requires U.S. taxpayers to annually file a Report of Foreign Bank and Financial Accounts (FBAR) if they own or are signatories to foreign financial accounts with a collective total value exceeding $10,000. Federal law has extablished severe penalties for failure to file an FBAR. Our Firm can assist you in resolving any outstanding FBAR issues as well as minimize penalities.

Marty is a Past President of the American Academy of Attorney-Certified Public Accountants. Using his extensive knowledge base as the impetus, he founded and chairs the group's IRS Tax Liaison Committee, which enables him to work side-by-side with high level officials at the IRS and other tax agencies, as well as with state and federal lawmakers.
Robbin is a Certified Public Accountant for the firm of E. Martin Davidoff, Attorney at Law. She is integrally involved in assisting clients in obtaining installment payment agreements and Offers in Compromise; and in the preparation of income tax returns for individuals and businesses in conjunction with the handling of various federal and state tax controversy matters.
Sarah joined us in January 2008. In March 2012 Sarah became an Enrolled Agent, licensed to practice before the Internal Revenue Service. She also represents clients with regards to state tax issues.

The story begins with the classic mistake of turning your family business over to the children with hopes of retiring. You know the rest! Finally, at wits ends dealing with the State regarding back taxes owed and a lien on a vehicle, we hired Davidoff tax attorney. Marty and associate Amy Marder, jumped right in with very useful knowledge, various plans, and a general "make you feel comfortable" approach to our mess. They were able to negotiate a reduction in interest and penalties and subsequently cut our tax obligation to 1/3 of what was owed. That also assured a release of the vehicle lien and a successful title transfer out of the business to our personal account. My husband and I have been dogged with tax issues as a result of the downturn in the economy back in 2008. Due to penalties, interest, ACA subsidy rescission and IRA liquidation; our debt to the IRS had become higher than our annual income. I was referred to Marty by a friend and was in need of a tax attorney and cpa for a $28K IRS issue which I could not afford to pay. I consulted over 5 Tax attorneys and CPAs who advised that the IRS would only slightly abate the taxes owed, penalties & interest, and requested huge retainers to assist me. Marty was the only attorney who consulted with my daughter as a courtesy. He advised me that I could negotiate a fair settlement for the debt. After engaging well meaning but inexperienced professionals over 4 years, the IRS painted an image of us that was far from the truth. They froze and emptied our bank accounts, contacted our employer by summons, and filed a levy on our income. We were paralyzed and shocked yet somehow managed to hold on to our conviction that none of this made sense. My husband was out of work for a time and we went through bankruptcy. That does not deter the IRS from coming after money they think is owed to them. The IRS sends notices to taxpayers for a variety of reasons: to notify you of changes to your account, to request additional information, to request payment of taxes, audit notification, etc. Each notice offers specific instructions as to how to satisfy the inquiry. If the IRS notice represents a more serious or complex issue, it is important you take immediate action. The consequences for ignoring an IRS notice may be dire and can include wage garnishment, asset seizure, arrest and jail time. Your best course of action is to contact a licensed tax professional who can advise you of your options and recommend your best course of action.

When a married couple files a return jointly, both parties are legally responsible for the entire tax liability, even additional tax, interest and penalities that arise after they divorce. Even if your divorce decree states that your former spouse will be responsible for any amounts due on previously filed returns, the IRS will still look to you to satisfy the debt.
